Im Internet ist ein Brief des Bundesbeauftragten für Datenschutz Peter Schaar an den Vorsitzenden des Deutschen Bundestages aufgetaucht. Der Brief verrät: Schaar konnte den Staatstrojaner nicht untersuchen.

Dem Chaos Computer Club wurde ein Brief Peter Schaars (Bundesbeauftragter für den Datenschutz und die Informationsfreiheit) zugespielt, der an den Vorsitzenden des Innenausschusses des Deutschen Bundestags adressiert ist. Der Brief ist auf den 14. August 2012 datiert. Darin schreibt Schaar, dass er die Analyse der Software zur Telekomunikationsüberwachung – auch bekannt als Staatstrojaner – nicht habe durchführen können. Begründung: Der Entwickler DigiTask hätte ihm den Quellcode nicht zur Verfügung gestellt, jedenfalls nicht ohne Bedingungen zu stellen.

Diese Bedingungen wollte Schaar jedoch laut Brief nicht akzeptieren. Als Bedingungen nennt Schaar „Kostenerstattungsansprüche und Geheimhaltungsabreden“. Der Bundesbeauftragte für Datenschutz nennt die Summe von 1.200 Euro pro Tag und Mitarbeiter, die DigiTask zum Ausgleich entstehender Kosten berechnen wolle. Außerdem solle er eine Geheimhaltungsvereinbarung unterzeichnen. Demzufolge steht auf der vorletzten Seite des Berichts: „Daher ist es mir im Ergebnis nicht möglich, den Quellcode zur datenschutzrechtlichen Kontrolle zu sichten.“

Schaar kritisiert den Staatstrojaner und besteht auf die Untersuchung des Quellcodes: „Nach wie vor erachte ich die bisherige Funktion zur Löschung kernbereichsrelevanter Inhalte für unzureichend. So können die unzureichenden Defferenzierungsmöglichkeiten hinsichtlich der zu löschenden Inhalte dazu führen, dass vorsorglich bestimmte, zur Wahrung des Kernbereichsschutzes zu löschende Inhalte weiterhin vorgehalten werden. Andererseits könnte auch dann, wenn diese Funktion dazu führt, dass ggf. "zuviel" Daten gelöscht werden, dies - etwa im Falle entlastender Beweise - Nachteile für den Betroffenen zur Folge haben. Ich halte an meiner Position fest, dass § 9 BDSG in verfassungskonformer Auslegung die Dokumentation des Quellcodes bei Maßnahmen der Quellen-Telekommunikationsüberwachung fordert.“
